Throughout the website, the terms “we”, “us” and “our” refer to BESTSELLER Australia Pty Ltd. Terms and Conditions for sale

The below terms and conditions ('Conditions") shall apply to all offers and purchase orders from BESTSELLER Australia Pty Ltd, 24 Best Avenue, 2088 NSW, Mosman, Australia ("BESTSELLER”), and all deliveries to customers purchasing goods via lilatelier.com.au ("Online Shop"). 

  1. Order

Any order placed in the Online Shop by you ("Order") is not binding on BESTSELLER unless BESTSELLER has given written acknowledgment of its acceptance on terms which include these Conditions ("Order Confirmation"). BESTSELLER will send an Order Confirmation to you by email when the product(s) has/have been dispatched.   The Order, the Order Confirmation, and these Conditions constitute the contract between BESTSELLER and you.

The order receipt received by you immediately after placing the order does not constitute an Order Confirmation. 

When placing an Order you warrant that you purchase the products in our Online Shop if for private and personal use only. You are not permitted to purchase our products for resale or any other commercial purpose.

  1. Products

BESTSELLER uses its best effort to display as accurately as possible the colours and images of the products that are available in the Online Shop. BESTSELLER cannot be held responsible for the accuracy of colours shown on your device's display. Subject to any rights that you may have under the Australian Consumer Law, any discrepancy between the colour displayed on your device’s display and the physical product will not be grounds for requesting a refund or exchange.

All descriptions of products are subject to change at any time without notice, at our sole discretion. BESTSELLER reserves the right to discontinue any product at any time.  We will not be liable to you or any other third party by reason of our withdrawing any product from our website, whether it has been sold or not, removing or editing any materials or contents on our Online Shop, or for refusing to accept an Order.

Fair use 

BESTSELLER reserves the right but is not obligated, to limit the sales of our products to any person, geographic region, or jurisdiction. BESTSELLER furthermore reserves the right to prevent persons from shopping via our Online Shop in case of a high number of returns. Moreover, the deactivation of customer accounts can also be triggered by suspected fraud by the person. 

  1. Prices, taxes, and delivery

All prices are stated in Australian dollars and are inclusive of GST. The applicable price is the one stated in the Online Shop in respect of the relevant product on the date of placing of the Order. 

BESTSELLER reserves the right to amend any prices incorrectly stated in the Online Shop and to limit the quantities of any products offered. Furthermore, BESTSELLER reserves the right to amend any prices, taxes and/or other costs stated in the Online Shop at any time and effective immediately upon posting to the Online Shop or other notification, e.g. due to changes in GST rates or other public fees and charges, increased costs or as a result of the general development in retail prices. Any such changes to prices and costs apply to Orders placed after the date of the change. Finally, BESTSELLER reserves the right to discontinue any product at any time.

Please note that some banks do charge an extra overseas transaction fee. This fee is charged by the bank and will not be reimbursed by BESTSELLER. For more information, please contact your bank. 

We accept payment by various methods including by credit card, PayPal, Google Pay, AfterPay, ApplePay, and other payment options as displayed in the Online Shop and during the checkout process.

When ordering products in the Online Shop, an amount may be added for payment of shipping costs depending on the delivery method chosen by you: 

 

Delivery within Australia

Australian Standard Postage (3-5 days) – $9.95 (Free for orders over $100)

Australian Express Postage (2-3 days) – $15.95

All orders are dispatched within 3 business days and delivery times generally take 3-10 days within Australia. 

Our warehouse team operates during business hours Monday – Friday, excluding NSW public holidays.

You’ll receive an email confirmation with your tracking number once your order has been dispatched. 

Lost or undelivered goods and delays

In case an order is lost in transit, you can contact our customer service in order for us to initiate an investigation with our couriers, however, BESTSELLER shall not be liable for lost orders.  Risk in the products passes to you when we hand over the products to the carrier. We do not accept liability for any loss, theft or damage to the products after dispatch from our warehouse. BESTSELLER shall not be responsible or liable for any products lost during shipping or delays resulting from the acts or omissions of third-party postal or courier services.

It is your obligation to enter the correct delivery address details at the time of ordering. If you have entered the wrong address, BESTSELLER is not obliged to re-send the order to the correct address. In case a product is returned to us as undeliverable, BESTSELLER will process a refund to you, deducting the delivery and return costs.

Payments may be subject to validation and authorization by both the card issuer/payment provider and us, to maintain security and prevent fraud. We reserve the right to decline certain payment methods and/or refer to a different payment method depending on the circumstances. 

  1. Returns

Nothing in these Conditions excludes, restricts or modifies the application of the Australian Consumer Law and any rights which you may have thereunder.  In the unlikely event that you are unhappy with your purchase, we accept refunds on items that are still in their original condition (new, tagged, unwashed, unworn) within 14 days of receiving your Order. To start a return, please visit our returns portal here. Please note, we do not accept returns on final sale items.

You will be responsible for the actual shipping costs to facilitate a change of mind return. This includes the costs of shipping the item to you in the first place and the cost of shipping it back to us. Items sent back to us without first requesting a return in writing will not be accepted.

Damages and issues

Please inspect the product upon receipt and contact us immediately if the item is defective, damaged or if you receive the wrong item so that we can evaluate the issue and make it right.

Refunds

We will notify you once we’ve received and inspected your returned item(s), and let you know if the refund has been approved or not. If approved, you’ll be automatically refunded on your original payment method. Please remember it can take some time for your bank or credit card company to process and post the refund.

5. Warranties and Liability

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

BESTSELLER is not liable for:

  • Normal wear and tear
  • Damage arising from abnormal use or abuse
  • Damage, wear and tear as a result of improper or lack of maintenance and/or care (e.g. fabric)
  • Damage to external or product packaging only which does not affect the product
  • Insignificant minor variations or imperfections in size, colour etc

BESTSELLER shall be entitled to cancel Order Confirmations or postpone agreed delivery of products in the rare event that a product should be or become unavailable after an Order Confirmation has been sent by BESTSELLER.

BESTSELLER shall not be liable for any loss or damage caused by delay in the performance or non-performance of any of its obligations under these Conditions occasioned by any cause whatsoever that is beyond BESTSELLERS’s control including but not limited to: Act of God; war; civil disturbance; requisitioning governmental restrictions, prohibitions or enactments of any kind; import or export regulations; strikes; lock-outs or other industrial disputes (whether involving its own employees or those of any other person); difficulties in obtaining workmen or materials; pandemics or epidemics; fires; or accident. If any such event occurs BESTSELLER may cancel or suspend any Order Confirmation without incurring any liability for any such loss or damage.

Subject to any rights which you may have under the Australian Consumer law, BESTSELLER's liability for any and all claims is limited to an amount equal to the price of the goods purchased by you. In no circumstances will BESTSELLER be liable for indirect or consequential losses whatsoever or howsoever arising.

These Conditions are governed by the laws of New South Wales, Australia and are subject to the non-exclusive jurisdiction of the courts of New South Wales.

Where is my order?

All orders are dispatched within 3 business days. Please keep in mind that delivery can take up to 3-10 business days within Australia. Our warehouse team operates during business hours Monday – Friday, excluding NSW public holidays. You’ll receive an email confirmation with your tracking number once your order has shipped.

Do I have to pay for shipping?

We offer free standard shipping on orders over $100 AUD. Orders under $100 have the below flat rate shipping fee: 

$9.95 AUD - Australia Post standard shipping (3-5 business days).

$15.95 AUD - Australia Post express shipping (2-3 business days).

Can I cancel/change my order?

Unfortunately, we can’t cancel / change your order, since we send your order information from the online shop directly to our warehouse system for a speedy delivery. 

Can I exchange an item?

Due to high stock turnover, we are unable to process exchanges or replacements, and our system does not support recreating orders on behalf of customers. For the quickest resolution, we recommend requesting for a refund or store credit through the returns portal, and placing a new order for the item/size you need.  We know you’ll find something else you’ll love!

How do I return my order?
