WHAT ARE THE TERMS AND CONDITIONS OF THE CUSTOMER CLUB?
These terms apply to our customer club.

Membership of our customer club is free and non-binding, and you can unsubscribe at any time. You must be at least 16 years of age to be a member of our customer club. If you are under the age of 16, you can sign up for our customer club by sending a signed confirmation from a parent or guardian to customerservice_au@bestseller.com.

By registering, you agree that BESTSELLER Australia Pty Ltd (ABN 15 607 105 368), 24 Best Avenue, 2088 NSW, Mosman, Australia (hereafter referred to as “BESTSELLER”) may send you marketing material.

Your consent includes marketing materials from the brand you sign up to and its sub-brands and any of the brands that you later select via your customer club profile.

Our marketing materials are sent via email, SMS, MMS, mail and social media such as Facebook, Instagram, etc. and relate to:

  • Our current and future product range, including clothes, shoes, bags, accessories, textiles, home accessories, designs, toys, magazines, and the like
  • Offers, sales, competitions, as well as events and other marketing initiatives from our online shops and stores or our partner stores.
  • Information about items you have added to your wish list via your online shop customer account or placed in your online shopping cart.

 

You further agree that this consent may be used to send requests for you to update your consent to include other relevant products, brands, business partners or communications channels.

 

You may unsubscribe from our customer club at any time and revoke your consent to receive marketing material by following the instructions in the messages we have sent to you or by contacting us at customerservice_au@bestseller.com. Please be aware that if you have subscribed to receive information regarding several brands, the withdrawal of your consent regarding one brand will not affect the consent for any other brands that you have subscribed to. You therefore have to unsubscribe from each brand individually.

 

YOUR PERSONAL DATA
BESTSELLER is data controller in relation to the customer club.

Your personal data is processed in accordance with our general privacy policy, which you can find HERE.

 

  1. What is your information used for?
    We use your personal information to manage the customer club and send you marketing materials, including promotions, news, invitations, etc.
    In order to optimize your shopping experience, we strive to send you marketing materials that match your interests and to send you customized newsletters, such as birthday greetings.

 

  1. What information do we process about you?
    We process the information you provide us in connection with your registration for a customer club and when you update your profile. This will include your name, email, date of birth and age, as well as your mobile number if you choose to provide it.
    We also collect information about your purchases and other activities on our online shop, including items in your shopping cart or items on your wish list. In addition, we measure your activity in connection with the receipt of our newsletters.

 

  1. On what basis do we collect your personal information?
    The collection of your personal data is based on your consent when you sign up for our customer club, cf. GDPR article 6 (1) (a).

You may withdraw your consent at any time, or object to the processing of your personal data for direct marketing purposes. To do so, you can contact us at customerservice_au@bestseller.com. If you do that, we will no longer send you marketing materials or other information based on your consent. Your personal data is also used for analytics and development and improvement of our products and services, based on our legitimate interests in doing so, cf. GDPR article 6 (1) (f).  

 

  1. Our use of data processors
    Your personal data may be transferred to external partners (data processors) who process the information on our behalf - for example, by posting our newsletters to you, or by storing your personal data.

The following data processor(s) can handle and/or store your personal data in countries outside the EU/EEA:

  • SHOPIFY, USA (the data transfer is safeguarded by EU Commission’s Standard Contractual Clauses)
  • DRIP, USA (the data transfer is safeguarded by EU Commission’s Standard Contractual Clauses)
  • Facebook, Inc., USA (the data transfer is safeguarded by EU Commission’s Standard Contractual Clauses)
  • Google, Inc., USA (the data transfer is safeguarded by EU Commission’s Standard Contractual Clauses)

In addition, some of our partners may use external subcontractors (sub-processors) located outside the EU. In such case, our partner is obligated to keep your personal data safeguarded. If you want specific information about these external sub-processors, please contact customerservice_au@bestseller.com.

 

  1. How long do we keep your personal data?
    Your personal data will be deleted when we no longer need it, and when we are no longer required to keep it by law.

If you opt out of our customer club, we will automatically delete the information that we are no longer required to keep by law, however, for documentation purposes we will e.g.. store your consent for a period of 2 years.

 

  1. Your rights and remedies, etc.
    As a data subject, you have certain rights, including the right to access the information we have registered about you.

Where is my order?

All orders are dispatched within 3 business days. Please keep in mind that delivery can take up to 3-10 business days within Australia. Our warehouse team operates during business hours Monday – Friday, excluding NSW public holidays. You’ll receive an email confirmation with your tracking number once your order has shipped.

Do I have to pay for shipping?

We offer free standard shipping on orders over $100 AUD. Orders under $100 have the below flat rate shipping fee: 

$9.95 AUD - Australia Post standard shipping (3-5 business days).

$15.95 AUD - Australia Post express shipping (2-3 business days).

Can I cancel/change my order?

Unfortunately, we can’t cancel / change your order, since we send your order information from the online shop directly to our warehouse system for a speedy delivery. 

Can I exchange an item?

Due to high stock turnover, we are unable to process exchanges or replacements, and our system does not support recreating orders on behalf of customers. For the quickest resolution, we recommend requesting for a refund or store credit through the returns portal, and placing a new order for the item/size you need.  We know you’ll find something else you’ll love!

How do I return my order?

Using our online return portal is a quick and easy way to initiate a return and let us know why you're returning the product. By selecting the reason for the return, you can help us improve our products and services based on your feedback.

Where is my return?

We will notify you once we’ve received and inspected your returned item(s), and let you know if the refund has been approved or not. If approved, you’ll be automatically refunded on your original payment method. Please remember it can take some time for your bank or credit card company to process and post the refund.
